A group of children from a nonprofit called Our Children’s Trust have taken an extreme call to action as they recently challenged the government regarding climate change.
The plaintiffs, children, ages 8-19, along with leading climate scientist, Dr. James Hansen, accused the government of “violating their constitutional rights to life, liberty and property, and their right to essential public trust resources, by permitting, encouraging, and otherwise enabling continued exploitation, production, and combustion of fossil fuels.”
The children organized a challenge against the lack of action by the government on human-induced global warming, claiming it will have a negative impact of future generations.
The plaintiffs allege that the federal government has a constitutional obligation under the fifth and ninth amendments to take action on matters that threaten their long-term future. They noted the government has been aware of the dangers of carbon dioxide and other greenhouse gasses for nearly fifty years, yet has failed to take action.
“The future of our generation is at stake,” said plaintiff Victoria Barrett, 16, in a statement. “People label our generation as dreamers, but hope is not the only tool we have.. I want to do what I love and live a life full of opportunities. I want the generation that follows to have the same chance.”
Another plaintiff said:
“This will be the trial of the century that will determine if we have a right to a livable future, or if corporate power will continue to deny our rights for the sake of their own wealth,” said 19-year-old lead plaintiff Kelsey Juliana.
Federal District Court Magistrate Judge Thomas Coffin ruled against an attempt to dismiss the case. He is retiring this year, so the next case will be reviewed by Judge Ann Aiken.
